FERC Sides With Louisiana Coop in NERC Challenge
As the Sutherland Coop team reported on July 25, the Federal Energy Regulatory Commission (FERC) sided with South Louisiana Electric Cooperative Association (SLECA) and ordered the North American Electric Reliability Corporation (NERC) to remove the coop from its compliance registry for distribution providers and load-serving entities. SLECA originally came under the compliance registry in 2008 when its generation provider determined that it should register with NERC under the federal reliability requirements in Section 215 of the Energy Policy Act of 2005. SLECA later realized that it should never have registered. As a result of SLECA’s successful appeal, other coops are questioning whether they should have to comply with NERC’s reliability standards.
